Fatawa al-Lajnah ad-Da'imah (1st Collection)
Fatwa No. 9779, vol. 8, p. 284
The scholars of the Permanent Committee for Scholarly Research and Ifta' (Al-Lajnah Ad-Dā’imah) have clarified that zakat is not due on inherited wealth immediately upon receiving it. Instead, the passage of a full lunar year (hawl) is a required condition for zakat to become obligatory on this wealth.
When an heir receives their portion of an inheritance, it is treated as new wealth or newly acquired benefit (māl mustafād). From the day the heir takes possession of this wealth, a new hawl begins for that specific amount. Zakat is only payable if the inherited amount meets the minimum threshold (nisab) on its own, or when combined with other zakatable assets the heir already owns, and this amount remains at or above the nisab for one complete lunar year.
The Committee stated in their ruling: "Zakat must be paid on inherited money if it reaches the nisab by itself, or when added to other money of the same type that you own, and one full Hijri year has passed since you acquired it."
Therefore, the heir should note the date they received the inheritance. If, after one lunar year from that date, their share is still equal to or greater than the nisab, they must pay 2.5% of it as zakat.
For ease of calculation, if the heir already has other wealth on which they pay zakat on a specific annual date, they can add the inherited wealth to their total assets and pay zakat on the entire sum on their established zakat due date. This avoids the difficulty of tracking multiple hawl periods for different assets.
Evidence
Hadith
This ruling is based on the general principle from the Sunnah that zakat is only due upon wealth after a year of possession. The Prophet (peace and blessings of Allah be upon him) said: 'There is no zakat on wealth until a year has passed over it.' (Narrated by Ibn Majah; classed as saheeh by al-Albani).
Key Takeaway
Zakat is not due on inherited wealth immediately upon receipt; rather, it becomes obligatory after a full lunar year (hawl) has passed from the date the heir takes possession, provided the amount meets the minimum threshold (nisab).
